Consumer Court Orders Kalyan Silks to Compensate Couple Over Refusal to Exchange Kurta

Thrissur: The Thrissur Consumer Court has ruled in favour of a couple who filed a complaint alleging refusal by a textile showroom to exchange an unsuitable kurta purchased for personal use.

The verdict was issued against the Managing Director of Kalyan Silks Trichur (P) Limited, located on Palace Road, Thrissur, following a petition filed by Seena and her husband Ranjith Kumar, residents of Thalikulam in Thrissur district.

According to the complaint, Seena had purchased a kurta for her husband. Since he was not present at the time of purchase, she had specifically enquired whether the garment could be exchanged if it did not fit properly. The showroom reportedly assured her that an exchange would be possible under such circumstances.

However, after taking the kurta home and trying it on, the garment was found unsuitable. When the couple approached the showroom seeking an exchange, they were allegedly informed that nothing could be done. The complainants also alleged that they were issued a bill printed on fading paper.

Following the showroom’s refusal to exchange the kurta under any circumstances, the couple approached the consumer court.

The Thrissur Consumer Disputes Redressal Commission, comprising President C.T. Sabu and members Sheeja S. and R. Ram Mohan, observed that the opposite party’s actions amounted to deficiency in service.

The court ordered the company to refund the kurta’s purchase price of ₹660 and pay compensation of ₹5,000 to the complainants.

In addition, the court directed the establishment to issue non-fading bills and clearly state its policy regarding return and exchange of products on customer invoices.

Advocate A.D. Benny appeared on behalf of the petitioners and argued the case before the court.
