Teachers Can Carry Cane for Discipline, But Must Not Harm Students: Kerala HC

In a significant ruling, the Kerala High Court has stated that school teachers are allowed to carry canes for maintaining discipline in classrooms, but they must not use them to physically harm students. The verdict was delivered by Justice P.V. Kunhikrishnan while hearing a petition regarding the legal boundaries of corporal punishment in schools.

The court clarified that while a cane can be kept as a symbol of authority to instill discipline, any form of physical violence against students is strictly prohibited. Additionally, the court ruled that teachers accused of misconduct cannot be arrested during the preliminary inquiry. However, if deemed necessary, authorities can issue a notice to the concerned teacher.

This ruling comes amid growing concerns over corporal punishment in schools, with child rights activists advocating for stricter regulations. The court’s stance aims to strike a balance between maintaining discipline and safeguarding students’ rights.
