New Delhi: The Supreme Court on Monday said it would examine decisions taken by the Election Commission (EC) and annul those found to be contrary to law.
A bench headed by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V Mohana, issued notices to the Centre and the EC on pleas alleging that several decisions were taken without the approval of the two election commissioners.
The court also clarified that it had not approved any modification to Form 6 used by the EC during the Special Intensive Revision (SIR) of electoral rolls in various states.
“We will examine all the decisions. If any decision is not in accordance with the law, we will annul it,” the bench said, while observing that the immunity granted to the Chief Election Commissioner was something even judges did not have.
