Owners of MSC Elsa 3 Move Kerala High Court to Limit Liability Over Ship Sinking Incident

Kochi – The owners of the cargo vessel MSC Elsa 3, which recently sank off the coast of Kerala, have approached the Kerala High Court seeking to limit their legal liability under maritime law for the incident.

The petition, filed under the Merchant Shipping Act, aims to cap the financial responsibility of the shipowners, arguing that their liability should be restricted based on the vessel’s tonnage — a common practice in international maritime claims.

The sinking of MSC Elsa 3 led to concerns over marine pollution, possible damage to cargo, and threats to marine life. Although no casualties were reported, the incident raised serious questions regarding compliance with safety norms and environmental regulations.

The High Court is now expected to review the maintainability of the petition and whether the owners are entitled to the legal protection they are seeking. The Kerala State Pollution Control Board, port authorities, and other concerned agencies may also be asked to file their responses.

Further hearings will determine the course of compensation and liability, especially if any third-party claims arise related to environmental damage or loss of goods.
